​Service Agreement

​

1. Scope of Services

​

Advanced Pest Innovations commits to providing pest control services, including any additional treatments deemed necessary, to the undersigned customer. These services are governed by the Terms and Conditions outlined on both sides of this agreement. Upon completion of the initial visit, the entire agreement becomes effective, and payment is due at the first treatment.

2. Payment and Guarantee

​

The Agreement guarantee remains valid only if full payment for the specified service(s) is received within thirty (30) days of service performance. Any additional or follow-up treatments performed on the property are covered under our guaranteed services, or at a discounted rate if applicable.

​

3. Entire Agreement

​

This one-page Agreement, along with the Terms and Conditions on the reverse side, constitutes the entire understanding between the parties. Advanced Pest Innovations reserves the right to collect the total amount due for the services described herein.

4. Service Details

​

All services performed on the property are considered full services. Interior follow-up treatments are provided only as required under the guarantee.

5. Binding Agreement

​

By signing below, I represent that:

​

• I am an authorized representative for the service address provided.

• I have read and fully understand this Agreement, including the content on the reverse side.

• I acknowledge the contracted services with Advanced Pest Innovations.

 

Cancellation Policy

​

You, the customer, may cancel this agreement at any time before midnight of the third business day after signing, provided written notice is sent to our Corporate address.

Future Damage and Services

​

Advanced Pest Innovations assumes no responsibility and does not provide guarantees against present or future damage to the building, property, or its contents. Additionally, this agreement does not cover the repair or replacement of any such damage. Furthermore, it does not extend to the control and elimination of termites, fungi, wildlife, or any other pests not explicitly listed in the agreement.

Limitation of Liability

​

The Customer acknowledges and expressly releases Advanced Pest Innovations from any liability related to personal injury, including stings or bites from fire ants, bed bugs, spiders, or any other pests. Additionally, this release extends to property damage, encompassing both the structure and its contents, caused by pests or the treatment thereof.

Under no circumstances shall Advanced Pest Innovations be held liable for an amount exceeding the payment made by the Customer for a single service. Furthermore, Advanced Pest Innovations disclaims responsibility for consequential damages resulting from the loss of property use. Any claims for damages must be submitted in writing within one (1) year of the incident in question; otherwise, they will be considered waived.

Access to Property

​

The customer is required to grant Advanced Pest Innovations unrestricted and secure access to the specified property for all necessary purposes related to fulfilling its obligations under this agreement. Failure to provide such access will result in the immediate termination of this agreement without further notice. The customer remains responsible for all outstanding payments for services rendered up to the point of termination.

Disclaimer

Advanced Pest Innovations shall not be held liable for any breach if circumstances beyond our control prevent the performance of services. Such circumstances include, but are not limited to, delays in transportation, fuel or material shortages, strikes, embargoes, fires, floods, quarantine restrictions, war, earthquakes, hurricanes, or any other acts of God.

Furthermore:

• Advanced Pest Innovations disclaims responsibility for damages resulting from the customer’s failure to provide notice or disclose existing damages.

• We are not responsible for any third party’s failure to disclose pre-existing infestations, damages, environmental issues, or structural damage before or after treatment.

This Agreement binds both parties to the agreed-upon service schedule. Advanced Pest Innovations explicitly disclaims any liability and shall not be held responsible for indirect, special, incidental, consequential, or loss of quiet enjoyment damages. The guarantees outlined in this agreement supersede any other guarantee, warranty (express or implied), including warranties of habitability, merchantability, or fitness for a particular purpose.

Changes in Legal Requirements

​

Advanced Pest Innovations diligently adheres to federal, state, and local legal requirements while providing its services. Should there be any modifications to existing laws that directly impact the services outlined in this agreement, Advanced Pest Innovations reserves the right to adjust the monthly service charge or, if necessary, terminate this agreement.

Non-Payment and Default

​

In the event of non-payment or breach by the customer, Advanced Pest Innovations reserves the right to terminate this agreement and demand full payment. Interest, at the highest legal rate allowed, will be assessed and borne by the customer during the delinquency period.

Should the customer’s breach prevent Advanced Pest Innovations from fulfilling the agreed-upon services or result in non-payment for those services, the customer will be invoiced for the total financed amount. Additionally:

1. Costs and Attorney Fees: If Advanced Pest Innovations is compelled to engage third-party attorneys or collection agencies to recover funds under this agreement, the customer shall bear all associated costs and attorney fees.

2. Award in Favor: If Advanced Pest Innovations receives an award in its favor related to services covered by this agreement, the customer remains responsible for all costs and attorney fees.

3. Agreed-Upon Services: The services agreed upon are binding upon the agent’s signature on the front of this agreement.

4. Third-Party Representatives: Any third-party representative involved shall be established between the relevant parties.

Miscellaneous

​

1. Delays and Performance: Delays caused by factors beyond the control of Advanced Pest Innovations, such as material availability or adverse weather conditions, may impact the start and completion dates of services. Advanced Pest Innovations shall not be held liable for any resulting delays or failure to perform. The specified dates for beginning and completion are not considered essential.

2. Property Damage: Advanced Pest Innovations assumes no liability for damage to lawns, shrubbery, trees, walks, driveways, patios, or buildings during the course of service.

3. Quality Assurance: All materials used by Advanced Pest Innovations will meet high-quality standards, and work will be executed in a professional manner. Any defects in workmanship reported within six (6) months from the service date will be rectified promptly at no additional cost to the property owners.

4. Warranty Conditions: The Advanced Pest Innovations warranty is contingent upon full payment of the entire agreement amount, including any extras, costs, fees, and applicable interest. No warranties or representations beyond those explicitly outlined herein are made by or on behalf of the contractor.

5. Binding Agreement: This agreement becomes binding upon acceptance within 30 days after the submitted date.

6. Cancellation Waiver: If service is rendered within three (3) business days of Advanced Pest Innovations receiving the signed agreement, the customer must send written notice expressly acknowledging and waiving their right to cancel service.

Refund Policy

​

Advanced Pest Innovations does not provide refunds or offer money back for services once work has been initiated based on the terms outlined in the reverse side of the agreement. Once work has commenced on the property, Advanced Pest Innovations asserts that all funds are due and reserves the right to collect any outstanding payments. This policy applies to situations involving property relocation, non-access to the property, and claims related to continued pest activity.

Privacy & Security Policy

​

At Advanced Pest Innovations, we hold your privacy in high regard and are committed to safeguarding your personal information. Rest assured that we neither sell nor share your details with any third parties. This information includes your name, address, and other identifying data that we use to efficiently service your property and account requirements. Your payment and personal information remain secure. Our Secure Sockets Layer (SSL) software adheres to industry standards and is among the best available for securing commercial transactions. It encrypts all sensitive data, including credit card numbers, names, and addresses, ensuring that it cannot be intercepted or read over the Internet.

Non-Transferable Policy

​

This Agreement is strictly non-transferable to any address other than the property address explicitly listed on the account. Additionally:

​

1. Continued Coverage: If the property name associated with the account no longer resides at or has ownership of the property, continued coverage is not permitted.

2. Scope of Policy: This policy applies to property tenants, landlords, or any party not explicitly listed on this agreement.

3. Service Requests: Advanced Pest Innovations reserves the right to decline service requests that do not originate from the designated account contacts.

Time-Based Agreement

​

Advanced Pest Innovations does not explicitly specify or imply a fixed number of services within this agreement. The signing party agrees to promptly notify Advanced Pest Innovations whenever required services are needed.

Additionally:

1. Information Updates: The signing party commits to informing Advanced Pest Innovations promptly of any changes to the information provided in this agreement. This includes updates to phone numbers, email addresses, or critical site details.

2. Non-Access Contact Information: Changes or requests related to non-access contact information from any party other than the listed customer on this agreement will not be considered a breach of the agreement.

3. Service Usage: Advanced Pest Innovations will not extend, supplement, or provide credits to customers for non-usage of their services.
